1. Acceptance of Terms
By downloading, installing, or using the Whiskd app ("the app", "Whiskd"), you agree to be bound by these Terms of Service ("Terms"). If you don't agree, please don't use the app.
Whiskd is operated from Melbourne, Australia ("we", "us", "our"). These Terms constitute the entire agreement between you and Whiskd regarding your use of the app.
2. Account Registration
Eligibility
You must be at least 13 years old to create an account. By registering, you confirm that you meet this requirement.
Your Account
- You're responsible for keeping your login credentials secure
- You're responsible for all activity that occurs under your account
- Notify us immediately at hello@getwhiskd.app if you suspect unauthorised access
- One account per person — don't create duplicate or fake accounts
- Your username and display name must not impersonate another person or brand
Account Deletion
You can delete your account and all associated data at any time from the Settings screen in the app. Deletion is permanent and cannot be undone.
3. User-Generated Content
What You Post
Whiskd lets you create and share content including matcha ratings, scores, flavour tags, tasting notes, photos, venue additions, and profile bios (collectively, "your content").
You Own Your Content
You retain ownership of any content you create. We don't claim ownership of your ratings, photos, or tasting notes.
License to Whiskd
By posting content on Whiskd, you grant us a non-exclusive, worldwide, royalty-free license to display, distribute, and use that content within the app and its related services (for example, showing your rating on a matcha detail page or in another user's feed). This license ends when you delete the content or your account.
Content Standards
Your content must:
- Be honest — ratings should reflect your genuine experience
- Be relevant — tasting notes and photos should relate to the matcha or venue being reviewed
- Be respectful — no hate speech, harassment, or targeted abuse
- Be appropriate — no explicit, graphic, or illegal content
- Not contain personal information about others without their consent
Public by Default
Your ratings, profile, and activity on Whiskd are visible to all users. This is a core feature of the app — a community discovery tool only works if contributions are shared.
4. Prohibited Conduct
When using Whiskd, you must not:
- Post fake reviews — ratings must be based on real experiences
- Spam — no repeated, irrelevant, or unsolicited content
- Harass or abuse — no threatening, abusive, or deliberately offensive behaviour toward other users
- Impersonate — don't pretend to be another person, brand, or Whiskd staff
- Scrape or harvest — no automated collection of data from the app without our written permission
- Reverse engineer — don't attempt to extract source code, bypass security measures, or access systems you're not authorised to use
- Interfere with the service — no actions that could damage, overload, or disrupt Whiskd's infrastructure
- Upload harmful content — no malware, viruses, or malicious code
- Violate the law — no content or conduct that breaks applicable laws or regulations
We reserve the right to remove content and suspend or terminate accounts that violate these rules.
5. Intellectual Property
Whiskd's IP
The Whiskd™ name, logo, app design, software, and all related materials are owned by us and protected by intellectual property law. You may not use them without our written permission.
Your License to Use the App
We grant you a limited, non-exclusive, non-transferable, revocable license to use the Whiskd app for personal, non-commercial purposes, in accordance with these Terms.
Feedback
If you send us feedback, suggestions, or ideas about the app, you grant us the right to use them without any obligation to you. We appreciate every piece of feedback — it genuinely shapes the product.
6. Disclaimers & Limitation of Liability
No Warranty
Whiskd is provided "as is" and "as available". We make no warranties — express or implied — about the app's reliability, accuracy, or fitness for any particular purpose. We can't guarantee the app will always be available, error-free, or that user-generated content (ratings, venue information) will be accurate.
Limitation of Liability
To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, or consequential damages arising from your use of the app. Our total liability to you for any claim is limited to the amount you've paid us in the past 12 months (which for most users is zero, since the app is free).
User Content
We are not responsible for the accuracy of ratings, venue information, or any other content posted by users. Matcha quality is subjective — one person's 5-star ceremonial might be another's 3-star. Use your own judgment.
Australian Consumer Law
Nothing in these Terms excludes rights you have under the Australian Consumer Law that cannot be excluded by contract. Where statutory guarantees apply, our liability is limited to resupply of the service.
7. Termination
By You
You can stop using Whiskd and delete your account at any time from the Settings screen.
By Us
We may suspend or terminate your account, with or without notice, if you breach these Terms, engage in conduct harmful to other users or the platform, or if we decide to discontinue the service. If we terminate your account without cause, we'll make reasonable efforts to notify you first.
Effect of Termination
On termination, your right to use the app ends immediately. Content you've posted may remain visible to others until removed. Your account data will be deleted in accordance with our Privacy Policy.
8. Changes to These Terms
We may update these Terms from time to time as the app evolves. We'll notify you of significant changes via the app or by email. The date at the top of this page reflects when the Terms were last updated.
Continuing to use Whiskd after changes take effect means you accept the updated Terms. If you don't agree with a change, you can delete your account before the change takes effect.
9. Governing Law
These Terms are governed by the laws of Victoria, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of Victoria, Australia, unless applicable consumer protection laws in your jurisdiction provide otherwise.
